1) Scope of Application
1.1 These General Terms and Conditions of the company MODERN DAYFARER UG (haftungsbeschränkt) (hereinafter referred to as "Seller") apply to all contracts a consumer or a trader (hereinafter referred to as "Client") concludes with the Seller relating to goods and/or services presented in the online shop.
1.2 The inclusion of the Client’s own conditions is objected to, unless otherwise agreed.
1.3 A "consumer" is any natural person who enters into a transaction for purposes which predominantly are outside his trade, business, or profession. A "trader" is a natural or legal person or a partnership with legal capacity who acts in the execution of his commercial or independent professional activity when entering into a legal transaction.
1.4 Digital content refers to all data not on a tangible medium, supplied in digital form and provided under specified usage rights precisely defined in these terms.

2) Conclusion of the Contract
2.1 Product descriptions in the online shop do not constitute binding offers; they serve for the submission of a binding offer by the Client.
2.2 The Client may submit the offer using the online order form. After placing selected goods/services in the virtual basket and completing the order process, and by clicking the button finalizing the order, the Client submits a legally binding contract offer regarding the goods/services in the basket. Offers can also be submitted to the Seller by email.
2.3 The Seller may accept the offer within five days by sending a written order confirmation or by delivering the ordered goods to the Client, or by asking the Client to pay after placing his order.

3) Right to Cancel
3.1 Consumers are entitled to the right to cancel.
3.2 Detailed information about the right to cancel is provided in the Seller’s cancellation policy.

4) Prices and Payment Conditions
4.1 Prices in the Seller’s product descriptions are total prices including statutory sales tax. Delivery costs are indicated separately in the respective product description.
4.2 Payment can be made using methods offered in the online shop.

5) Shipment and Delivery Conditions
5.1 Goods are generally delivered to the delivery address provided by the Client unless otherwise agreed.
5.2 If the transport company returns the goods to the Seller because delivery to the Client was not possible, the Client bears the cost for the unsuccessful shipment.

6) Reservation of Proprietary Rights
The Seller retains ownership of the delivered goods until full payment of the purchase price.

7) Warranty
7.1 If the purchased item is defective, statutory warranty provisions apply.
7.2 For consumers, the warranty period for used items is one year from delivery of the goods.

8) Redemption of Campaign Vouchers
8.1 Campaign vouchers issued free of charge during promotional activities cannot be purchased and are redeemable only within the specified period and in the Seller’s online shop.

9) Applicable Law
All legal relationships between the parties are governed by the law of the Federal Republic of Germany excluding the laws about the international purchase of movable goods. For consumers, this law applies only to the extent that provided protection is not withdrawn by mandatory provisions of the consumer's usual residence.

10) Place of Jurisdiction
For disputes arising from this contract, the place of jurisdiction is the Seller’s place of business in Germany, provided the Client is a merchant, a legal entity of public law, or a special fund under public law.

11) Alternative Dispute Resolution
The EU Commission provides an online platform for dispute resolution which can be accessed at https://ec.europa.eu/consumers/odr. The Seller is neither obliged nor prepared to participate in a dispute settlement procedure before an alternative dispute resolution entity.
